The prosecution in the triple-murder trial of Glen Sebastian Burns and Atif Rafay have a problem on their hands.  It seems as though the Canadian police mounted an investigation against the demonic duo that would make the architects of the US constitution roll over in their graves… and apparently the Bellevue Police Department helped them!

The defense is arguing that Canadian undercover cops pretended to be mobsters in order to gain the confidence of said defendants, and even told them they had a mole in the Bellevue Police Department who was helping them gather information on the investigation.  The problem is that in the US you have what are known as “rights,” and one of those rights is to know you are talking to a police officer when you are the subject of a criminal investigation.

They were not in the United States, however, they were in Canada, so the prosecution has nothing to worry about, right?  Wrong.  In order to gain their confidence, those skillful mobsters wanted to show the alleged murderers that they were “legit.”  So they had someone in the BPD fax them some info on the case.  Therein the problem lies.  If the Bellevue Police Department helped in the Canadian’s unconstitutional investigation, it could be curtains for the prosecution.  The majority of their case is based on testimony from the undercover Canadian cops.

King County Superior Court Judge Charles W. Mertel is expected to rule next month whether the Canadian undercover evidence can be used in a Washington state court.
